Eligibility and Registration
- To register for the Services, the Client must complete our booking/registration form (via the Site or directly with our admin team) and provide accurate, current, and complete information about themselves and/or the Student.
- Where the Client is a parent or guardian booking on behalf of a Student under 18, the Client confirms they hold parental responsibility, or are otherwise authorised to enter into this Agreement on the Student’s behalf.
- We reserve the right to decline registration or terminate an existing arrangement at our discretion, including where we cannot provide a suitable Tutor or where information provided is false or misleading.
Trial Lessons and Tutor Matching
4. Prospective Clients may book a trial lesson via the “Book Your Trial Lesson” form on the Site. Trial lesson terms will be confirmed at the time of booking
5. We aim to match Students with a Tutor suited to their subject, level, and exam board, based on the information provided at registration. While we make reasonable efforts to accommodate specific preferences, we cannot guarantee the availability of a particular Tutor at all times.
6. If a Client is not satisfied with a matched Tutor, please contact us and we will endeavour to arrange a suitable alternative.
Tutors, Safeguarding and DBS Checks
7. All Tutors engaged by Elephant Connect are required to hold an Enhanced DBS (Disclosure and Barring Service) certificate before commencing tutoring with Students.
8. Tutors are interviewed and vetted by our Director prior to being onboarded, and their qualifications and experience are verified so far as reasonably practicable.
9. Elephant Connect is committed to safeguarding the welfare of all Students. Any safeguarding concern should be reported immediately to administrator@elephantconnect.com or by telephone, and will be treated with the appropriate seriousness and confidentiality.
10. Online Sessions should take place in an appropriate, supervised environment. Parents/guardians of Students under 18 are responsible for reasonable supervision of online sessions, particularly for younger children.
11. Tutors are independent contractors engaged by Elephant Connect and not employees of the Client. Clients must not attempt to engage a Tutor introduced through Elephant Connect privately, bypassing our Services, for a period of 12 months following the last Session booked through us (see Clause 12, Non-Circumvention).
Fees and Payment
12. Session fees, package rates, and any applicable registration or administration fees will be communicated to the Client prior to booking and are set out in the relevant quotation, invoice, or booking confirmation.
13. Payment is due in accordance with the terms specified on the invoice or booking confirmation (for example, in advance of a block of Sessions, or monthly in arrears), unless otherwise agreed in writing.
14. We accept payment by the methods specified at the time of booking. All fees are quoted in Pounds Sterling (GBP) unless otherwise stated.
15. We reserve the right to suspend Sessions where payment is significantly overdue, having given the Client reasonable written notice.
16. We may vary our fees from time to time; any change will not affect Sessions already booked and paid for, and reasonable notice will be given before a fee change takes effect for future bookings.
Cancellations, Rescheduling and Refunds
Cancellation by the Client (individual Sessions)
17. Clients wishing to cancel or reschedule a booked Session should provide at least [insert notice period, e.g. 24 hours] written notice to our admin team.
18. Sessions cancelled with less than the required notice may be charged in full, as the Tutor’s time will have been reserved.
Your right to cancel the Agreement (UK Consumer Contracts Regulations 2013)
19. Where the Agreement is concluded at a distance (for example, online or by phone) and you are a consumer, you ordinarily have a statutory right to cancel within 14 days of entering into the Agreement without giving a reason, under the Consumer Contracts (Information, Cancellation and Charges) Regulations 2013.
20. If you ask us to begin providing Sessions during this 14-day cancellation period, you acknowledge and agree that: (a) if you cancel after Sessions have started, you will be liable to pay for the Services provided up to the point of cancellation; and (b) once the Services are fully performed, you lose the right to cancel, even if the 14-day period has not expired.
21. To exercise your right to cancel, please notify us in writing (email is acceptable) at administrator@elephantconnect.com, stating your name, booking reference, and the Services you wish to cancel.
22. This statutory cancellation right does not affect your other rights, including your rights under the Consumer Rights Act 2015 where Services are not provided with reasonable care and skill.
Cancellation by Elephant Connect
23. If a Tutor is unavailable due to illness or unforeseen circumstances, we will notify the Client as soon as reasonably possible and offer a rescheduled Session or, where this is not possible, a refund or credit for the affected Session.
Refunds
24. Where a refund is due under these Terms or applicable consumer law, we will process it within 14 days using the original payment method, unless otherwise agreed.
25. Unused Session credits within an active package are non-transferable to third parties but may be used by the same Student within a reasonable period, as agreed with our admin team.
Delivery of Services
26. Sessions may be delivered online (via video-conferencing platforms) or in person, as agreed between the Client and Elephant Connect.
27. We will use reasonable care and skill in delivering the Services, in line with the Consumer Rights Act 2015, but we do not guarantee specific academic outcomes, grades, or examination results, as these depend on factors outside our control, including the Student’s own engagement and effort.
28. Progress monitoring, mock exams, and review sessions with our Director are offered as described on the Site and will be scheduled in line with our standard practice (typically 4–6 weeks after registration).
Client and Student Responsibilities
The Client agrees to:
29. provide accurate information relevant to the Student’s learning needs, exam board, and any special educational needs or disabilities the Tutor should be aware of;
30. ensure the Student attends Sessions punctually and has access to a suitable device and internet connection for online Sessions;
31. treat Tutors and Elephant Connect staff with courtesy and respect; and
32. notify us promptly of any concerns regarding a Tutor or the Services.
Intellectual Property
33. All content on the Site, including text, graphics, logos, and course materials created by Elephant Connect or its Tutors, is owned by or licensed to Elephant Connect Education and is protected by copyright and other intellectual property laws.
34. Materials provided during Sessions (worksheets, notes, mock papers, etc.) are provided for the Student’s personal educational use only and may not be reproduced, resold, or distributed without our prior written consent.
Data Protection and Privacy
35. We process personal data (including data relating to Students under 18) in accordance with the UK General Data Protection Regulation (UK GDPR), the Data Protection Act 2018, and, where relevant to EU-based Clients, the EU General Data Protection Regulation (EU GDPR).
36. Details of what personal data we collect, how we use it, our legal bases for processing, retention periods, and your rights (including access, rectification, erasure, and complaint to the Information Commissioner’s Office) are set out in our separate Privacy Policy, which forms part of this Agreement.
37. We do not sell personal data to third parties. Data is shared with Tutors and service providers (e.g. payment processors, video-conferencing platforms) only as necessary to deliver the Services.
38. Any safeguarding-related information shared with us will be handled confidentially and only disclosed where necessary to protect the welfare of a Student or as required by law.
Non-Circumvention
39. In consideration of the time and cost involved in recruiting, vetting, and DBS-checking our Tutors, the Client agrees not to engage a Tutor introduced by Elephant Connect directly (i.e. outside of our booking and payment system) during the course of the Agreement and for a period of 12 months after the last Session booked through Elephant Connect, without our prior written consent. Breach of this clause may result in an introduction fee becoming payable, as reasonably determined by us to reflect our recruitment and vetting costs.
Limitation of Liability
40. Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under English law.
41. Subject to the above, our total liability to the Client arising out of or in connection with the Agreement, whether in contract, tort (including negligence), or otherwise, shall not exceed the total fees paid by the Client for the Services in the 12 months preceding the event giving rise to the claim.
42. We are not liable for any indirect or consequential loss, including loss of opportunity, or for outcomes such as examination results or university admissions decisions, which depend on factors beyond our control.
43. We are not liable for temporary unavailability of the Site or online Session tools due to technical issues, internet connectivity, or third-party platform outages, though we will act promptly to resolve such issues where within our control.
Complaints
44. If you are unhappy with any aspect of the Services, please contact us at administrator@elephantconnect.com in the first instance, and we will aim to acknowledge your complaint within 5 working days and resolve it promptly and fairly.
45. If a complaint cannot be resolved directly, and you are an EU-based consumer, you may also be entitled to use the European Commission’s Online Dispute Resolution (ODR) platform, where applicable, or an equivalent independent alternative dispute resolution (ADR) provider in the UK.
Force Majeure
46. We shall not be liable for any failure or delay in performing our obligations under this Agreement where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, industrial action, internet or power outages, or government restrictions.
Changes to These Terms
47. We may update these Terms from time to time to reflect changes in our Services, legal or regulatory requirements. The updated Terms will be posted on the Site with a revised “last updated” date. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms. Material changes affecting an active booking will be communicated to affected Clients directly.
Governing Law and Jurisdiction
48. These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes) shall be governed by and construed in accordance with the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction, save that if you are a consumer resident in the EU or elsewhere, you may benefit from mandatory consumer-protection provisions of your local law, and nothing in these Terms removes protections you are entitled to under the law of your country of residence.
General
49. Severability: if any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
50. Entire Agreement: these Terms, together with any booking confirmation and our Privacy Policy, constitute the entire agreement between the Client and Elephant Connect Education regarding the Services.
51. No Waiver: failure to enforce any provision of these Terms shall not constitute a waiver of that provision.
52. Assignment: the Client may not assign or transfer rights or obligations under this Agreement without our prior written consent.
